NEVI Program

• The National Electric Vehicle Infrastructure (NEVI) Formula Program will provide $5 billion over five years to help states create a network of electric vehicle (EV) charging stations along designated Alternative Fuel Corridors, particularly along the Interstate Highway System.
• NEVI was established as part of the Bipartisan Infrastructure Law (BIL) of 2021, also known as the Infrastructure Investment & Jobs Act (“IIJA”).
• The program will also establish an interconnected network to facilitate data collection, access, and reliability.
• In order to qualify for program funding, each state and territory is required to submit an EV Infrastructure Deployment Plan (EVIDP) to the U.S. Department of Transportation (DOT) and U.S. Department of Energy (DOE) newly formed Joint Office for “review and public posting” describing how the state intends to distribute NEVI funds. As of August 2022, all 50 states, DC and Puerto Rico have submitted their EVIDPs and now await approval from the FHWA on a rolling basis (September 30, 2022 deadline).

The FHWA outlined program guidance that must be met regardless of the location of the project, including:

Location Requirements:

• Sites must be located along FHWA designated Alternative Fuel Corridor
• Sites must be located at least 50 miles from an existing NEVI-compliant EV charging site
• Sites must be publicly available 24/7, 365 days of the year
• Sites must provide onsite amenities, i.e. restrooms, WiFi, shelter, etc
• Adequate parking space to ensure compliance with ADA requirements and other local permitting requirements

Charging Infrastructure Requirements:

• Charging stations must be capable of simultaneously charging four EVs
• Charging stations must have a total capacity at or above 600 kW, or at least 150 kW per port
